Terms & Conditions for Hope Graphics Co.

Welcome to Hope Graphics Co. (“we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website and services, including but not limited to printing, advertising, branding design, video ad content creation, and corporate gifting. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

1. Services and Quotes

* *Service Agreement:* All services are provided subject to a separate project agreement or a formal quote approved by the client. The quote will detail the scope of work, deliverables, pricing, and estimated timelines.
* *Quote Validity:* All quotes are valid for a period of *30 days* from the date of issue.
* *Changes to Scope:* Any changes to the project scope after the quote has been approved may result in additional charges and an adjustment to the project timeline.

2. Client Responsibilities

* *Content and Materials:* You are responsible for providing all necessary content, including text, logos, images, and other materials, in the required format and by the agreed-upon deadlines.
* *Proofing and Approval:* For all custom orders (printing, design, etc.), we will provide a final proof for your review and approval. It is your sole responsibility to carefully check all details, including spelling, grammar, colors, and layout. *Hope Graphics Co. is not liable for any errors present in an approved proof.*
* *Copyright and Permissions:* You warrant that all materials provided to us are either owned by you or that you have the necessary licenses, rights, and permissions to use them. You agree to indemnify and hold Hope Graphics Co. harmless from any claims, damages, or costs (including legal fees) arising from copyright infringement or other intellectual property violations related to the materials you provide.

3. Payment Terms

* *Invoicing:* We will issue invoices according to the payment schedule outlined in your project agreement or quote.
* *Payment Schedule:* A down payment, typically *50% of the total project cost*, is required to commence work. The remaining balance is due upon project completion or before the final delivery of physical goods.
* *Late Payments:* We reserve the right to suspend work on your project or withhold final deliverables if payments are not made according to the agreed-upon schedule. A late fee may be applied to overdue balances.

4. Intellectual Property Rights

* *Client Ownership:* Upon full and final payment, you will own the final design files, printed products, video content, and other deliverables. This does not include any raw, working, or source files unless explicitly stated and agreed upon in the project quote.
* *Hope Graphics Co. Rights:* We retain the right to use completed project deliverables for our portfolio, marketing materials, and case studies, unless you request a non-disclosure agreement (NDA) in writing at the beginning of the project. We also retain all intellectual property rights to our proprietary tools, methodologies, and any design elements not created specifically for your project.

5. Cancellations and Refunds
* *Cancellation Policy:* If a project is canceled by the client, any down payments or fees for work completed up to the point of cancellation are *non-refundable*.
* *Refunds:* Due to the custom nature of our services, we do not offer refunds. However, we will work with you to resolve any issues related to manufacturing defects or fulfillment errors on our part as outlined in our separate *Return Policy*.

6. Disclaimer of Warranties

Our services are provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that our services will be uninterrupted, error-free, or secure.

7. Limitation of Liability

To the fullest extent permitted by law, Hope Graphics Co. will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with our services or these Terms, even if we have been advised of the possibility of such damages. Our total liability to you for any and all claims related to our services will not exceed the total amount paid by you to us for the specific services in question.

8. Governing Law and Jurisdiction

These Terms and any disputes arising from them will be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts of Jeddah, Saudi Arabia.

9. Changes to Terms

We reserve the right to update these Terms at any time. We will post the revised Terms on our website and update the “Effective Date” at the top. Your continued use of our services after any changes indicates your acceptance of the new Terms.
